Mukurweini MP John Kaguchia has been released on a cash bail of KSh250,000 or a bond of KSh1 million after spending the night in custody at Kamukunji Police Station.
Milimani Senior Principal Magistrate Theresa B. Nyangena ordered his release but deferred plea-taking after the prosecution presented a charge of offensive conduct conducive to a breach of the peace, contrary to Section 94(1) of the Penal Code.
During the proceedings, Kaguchia’s legal team argued that both the Milimani and Kiambu courts had earlier ordered his release, accusing the police of deliberately defying the directives. The defence specifically faulted officers at Kamukunji Police Station, including the Officer Commanding Station (OCS), for allegedly ignoring court orders granting the legislator bail.
The Office of the Director of Public Prosecutions (ODPP) accuses Kaguchia of making inflammatory remarks during a public gathering in Kieni, Nyeri County. Prosecutors allege that the MP told residents that anyone from the Mt Kenya region who voted for President William Ruto would be isolated from the community.
The defence also questioned the decision to file the case in Nairobi, arguing that the alleged offence occurred in Naro Moru, Nyeri County, and should therefore have been prosecuted there.
