Aga Khan Fined KSh 1 Million Over Mother’s Death

A mother went to hospital to deliver her second child but died days later after developing a serious infection. Seven years on, Aga Khan University Hospital has been fined KSh 1 million over failures in her care, raising questions about accountability and patient safety in Kenya’s healthcare system.

The Kenya Medical Practitioners and Dentists Council (KMPDC) fined the hospital over the death of Valarie Cherono Misoi, who died on September 1, 2019, following childbirth at the facility in Nairobi. The council’s disciplinary committee found shortcomings in her treatment and management that contributed to her death.

Misoi had received antenatal care at the hospital during her pregnancy. On August 18, 2019, she presented with diarrhoea, abdominal pain and an elevated heart rate. Medical investigations were initiated, but she did not return for a scheduled review within three days, according to testimony presented during the inquiry.

She went into labour on August 27 and delivered a baby girl through normal vaginal delivery in the early hours of August 28. She was discharged on August 29 after reporting leg pain and undergoing investigations for a possible blood clot. She later developed serious complications linked to an infection and died on September 1.

The disciplinary findings raised concerns about delays in administering antibiotics and transferring Misoi to critical care after her condition deteriorated. The committee concluded that failures in her treatment materially contributed to her deterioration and eventual death.

In addition to the fine, the hospital was ordered to review and update its medical protocols, strengthen procedures for investigating maternal and perinatal deaths, and communicate revised guidelines to its staff and medical contractors.

The council also directed the hospital to enter mediation with Misoi’s husband, Lawrence Oyaro, and report the outcome within 90 days. The family is seeking KSh 100 million in compensation, although that amount is a claim and not part of the KSh 1 million regulatory fine.

The case has renewed scrutiny of maternal healthcare and the importance of timely diagnosis, treatment and escalation of care when patients develop potentially life-threatening infections after childbirth.

The case leaves a difficult question , is a KSh 1 million fine sufficient accountability when a family has lost a mother and a child has lost a parent?
