Grade 9 Learner Gets Life Sentence For Defiling A School Boy
A classroom should be a place of safety, not a scene of abuse. A Lamu court has sentenced a 19-year-old learner to life imprisonment after finding him guilty of defiling a nine-year-old pupil, in a case that has left the young victim traumatised and forced to change schools for his safety .Raising fresh concerns about child protection within school environments .
Ali Hussein Kutu, a Grade 9 learner, was sentenced by Lamu Principal Magistrate Peter Wasike after the court found him guilty of defiling a Grade 3 pupil at a primary school in Langoni Location, Lamu Central Sub-County.
The offence occurred on October 3, 2025, at a school identified in court reports as “A” Primary School. The prosecution called five witnesses during the trial, presenting evidence that persuaded the court to convict Kutu beyond reasonable doubt.
The court relied on the child’s testimony and medical evidence, which corroborated the offence. It rejected Kutu’s claim that he had been framed, finding no apparent personal dispute or grudge that would explain why the child would falsely accuse him.
The impact on the young survivor extended beyond the courtroom. A victim impact statement and pre-sentence report presented to the court indicated that the child suffered trauma and nightmares following the incident. He was subsequently transferred to another school for his safety.
In sentencing, the court acknowledged that Kutu was a first-time offender and had a positive school record. However, the magistrate ruled that these factors could not override the penalty prescribed by law for defilement involving a child aged 11 years or below.
The sentence was imposed under Section 8(1), read together with Section 8(2) of Kenya’s Sexual Offences Act, which prescribes life imprisonment for defilement of a child aged 11 years or younger.
Kutu, who had been in custody since October 15, 2025, was sentenced to life imprisonment and given 14 days to appeal the conviction and sentence.
